Monthly content packages and marketing support

Custom QR codes and print-ready materials

All service-specific deliverables and terms will be outlined in separate contracts, proposals, or package descriptions.

2. User Obligations

By using our Site or Services, you agree to:

Provide accurate, current, and complete information

Maintain the security of your account credentials

Use our Services in accordance with applicable laws and ethical standards

Provide necessary materials (photos, videos, branding assets) in a timely manner for service delivery

You may not use the Site or Services to:

Infringe upon intellectual property rights

Transmit malicious code or harmful content

Engage in spam, unauthorized marketing, or unlawful activity

Misrepresent yourself or your real estate credentials

3. Intellectual Property

All content, designs, code, graphics, templates, logos, and intellectual property displayed on our Site or produced for clients are the exclusive property of The List House or its licensors. Unauthorized use, copying, or distribution is strictly prohibited.

By engaging our Services, you grant us a non-exclusive, royalty-free license to use your submitted content (including listing photos, branding materials, and client testimonials) as necessary to fulfill your project or campaign, including promotional or portfolio use unless otherwise agreed upon in writing.

Content created for you (social media posts, reels, graphics, email templates) becomes your property upon full payment, with the understanding that The List House retains the right to showcase such work in our portfolio and marketing materials.

4. Payment Terms

Fees:
Prices are quoted in package descriptions, contracts, or proposals and are subject to change with notice.

Payments:
Payment is due based on the terms agreed (e.g., upfront for one-time services, monthly recurring for subscription packages). Accepted methods may include credit card, ACH transfer, PayPal, or Stripe.

Monthly Subscriptions:
Monthly packages renew automatically until canceled. Cancellation requires 30 days' written notice via email to [email protected].

Late Payments:
Late payments may incur fees. Continued non-payment may result in service suspension or account termination.

Refund Policy:
Due to the custom nature of our services, refunds are generally not provided once work has commenced. Specific refund terms will be outlined in individual service agreements.

5. Service Delivery & Turnaround

Turnaround Times:
We strive to meet quoted turnaround times (e.g., 48 hours for one-off services, monthly delivery by the 1st). Timelines depend on timely receipt of required materials from clients.

Revisions:
Each service includes a specified number of revisions. Additional revisions may incur extra fees.

Client Approval:
Content is delivered for your review and approval before posting. You are responsible for final approval and posting unless posting services are explicitly included in your package.

6. Confidentiality

We treat all client information, listing details, business strategies, and personal data as confidential. We will not share or sell your confidential information unless required by law or with your explicit permission.

You agree to treat our proprietary materials, templates, systems, and methodologies with the same confidentiality.

7. Termination

We reserve the right to suspend or terminate access to our Site or Services at any time for violations of these Terms or to protect our business interests.

Clients may terminate their agreement in writing per the terms of the specific contract or package. For monthly subscriptions, 30 days' written notice is required. All outstanding payments up to the date of termination will remain due.

8. Disclaimers & Limitation of Liability

No Guarantees:
While we aim for high-quality results, we do not guarantee specific performance outcomes (e.g., social media engagement, follower growth, lead generation, or sales increases).

Limitation of Liability:
The List House shall not be liable for indirect, incidental, special, or consequential damages. Our liability shall not exceed the total fees paid for the specific Services giving rise to the claim.

Third-Party Platforms:
We are not responsible for changes to third-party platforms (Instagram, Facebook, Google, etc.) that may affect service delivery or performance.

9. Indemnification

You agree to indemnify and hold harmless The List House, its employees, contractors, and affiliates from any claims, damages, liabilities, costs, or expenses (including legal fees) arising out of your use of the Site or Services, your breach of these Terms, or any content you provide for our services.

10. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of California. Any disputes shall be resolved through binding arbitration in Ventura County, California, in accordance with applicable U.S. arbitration rules.

11. Privacy Policy

Your use of the Site and Services is also governed by our Privacy Policy, which outlines how we collect, use, and protect your personal data.

12. Modifications to These Terms
